To the maximum extent permitted by law, Tyche Trades, its owners, directors, employees, contractors, and affiliates shall not be liable under any circumstances, including negligence, for any financial losses (including total loss of funds), loss of profits, revenue, or opportunity, direct, indirect, incidental, punitive, or consequential damages, errors, omissions, delays, or failures in signal delivery, or system outages, technical failures, or third-party issues.

6. Indemnification

You agree to fully indemnify, defend, and hold harmless Tyche Trades and its affiliates from any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your use or misuse of the service, your trading activity, or your violation of these terms.

7. No Fiduciary or Advisory Relationship

You acknowledge that no fiduciary, advisory, or professional relationship exists between you and Tyche Trades under any circumstances.

8. "As-Is" Service Disclaimer

All services are provided "as is" and "as available", without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

9. No Reliance Clause

You agree that you have not relied on any statements, representations, or guarantees made by Tyche Trades in deciding to use the service or engage in trading.

10. No Refund Policy (Strict)

All payments made to Tyche Trades are final and non-refundable under all circumstances, including but not limited to dissatisfaction, lack of usage, or trading losses.

11. Subscription Terms

Services are offered on a subscription basis. By subscribing, you authorize automatic recurring billing until cancellation. You are responsible for managing your subscription and cancellation.

12. Cancellation Policy

You may cancel your subscription at any time. Cancellation only applies to future billing cycles. No partial refunds or prorated refunds will be issued for any unused time.

13. Chargebacks & Disputes

Initiating a chargeback or payment dispute without valid legal grounds constitutes a breach of these terms. Tyche Trades reserves the right to pursue legal action, recover fees, and permanently terminate access to services.

14. Jurisdiction & Compliance

You are solely responsible for ensuring that your use of the service complies with all applicable laws and regulations in your jurisdiction.

15. Age & Capacity

You confirm that you are of legal age and have the full legal capacity to enter into this agreement.

16. Binding Agreement

By creating an account or using the service, you irrevocably agree to these terms in full. If you do not agree, you must not use the service under any circumstances.

17. Arbitration Agreement

You agree that any dispute, claim, or controversy arising out of or relating to your use of Tyche Trades or these Terms shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be conducted on an individual basis only. You waive any right to a trial by judge or jury.

18. Class Action Waiver

You agree that any claims or disputes must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You expressly waive any right to participate in a class action lawsuit or class arbitration against Tyche Trades.
